Terms of Service for Generor

Welcome to Generor, a web app / website owned and operated by Alexiuz AS ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, generor.com, and the AI bot services provided therein (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
2. Description of Service
Generor is powered by a range of AI APIs, including but not limited to those from Anthropic, Google, and OpenAI. The AI bot is designed to provide friendly interactions and general information but does not offer professional advice.
3. User Conduct
3.1 Prohibited Use
You agree not to use Generor to:
- Request legal, medical, financial, or other professional advice.
- Share private details about any person other than yourself without explicit written permission.
- Request any of the generators to generate content that is protected by copyright, or otherwise illegal in your country.
- Generate images, text, and other content that is harmful, dangerous, pornographic, sexual, sexually implicit related to minors, racist, violent, brutal, contains nudity, or is otherwise strongly inappropriate.
If you generate content that is against the rules, we will delete it, and ban or otherwise penalize your account. No refunds are given in such cases.
3.2 User Responsibility
You are responsible for all content you generate while using the Service. Alexiuz AS is not responsible for any content generated. If you accidentally generate content that is against the rules, please contact us and delete the content. We will refund your oomph used and use your feedback to improve our systems.
You agree to use the Service in compliance with all applicable laws and regulations.
4. Disclaimers
No Professional Advice: The AI bot is not a substitute for professional advice. Do not rely on the information provided for legal, medical, financial, or other professional decisions.
Accuracy of Information: Generative AI models may provide inaccurate or inappropriate information that does not represent the views of Alexiuz AS. We do not guarantee the accuracy, completeness, or usefulness of any information provided.
5. Intellectual Property
All content, features, and functionality on the Service (excluding content generated by users) are the exclusive property of Alexiuz AS and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
Rights regarding content generated by users via the Service are governed by our Content License.
6. Payments and Refunds
6.1 Oomph System
Generor uses a virtual currency called "oomph" to access AI generation services. Oomph costs vary based on the type of content generated and the AI model used.
Types of Oomph:
- Paid Oomph: Credits purchased through our payment processing partners. To the maximum extent permitted by applicable law, paid oomph expires 5 years after the date of purchase and any remaining unused balance will then be forfeited and have no cash value. In jurisdictions where applicable law does not allow expiry of prepaid balances, this expiry provision does not apply and your paid oomph will instead be treated in accordance with such laws (including any unclaimed property or refund requirements).
- Free Oomph: Complimentary daily credits granted automatically to all verified users. You receive 50 free oomph every day, with a maximum balance of 250 free oomph.
Spending Priority: When generating content, your free oomph is spent first, followed by paid oomph. This ensures you always maximize the value of your daily free credits before using purchased credits.
6.2 Oomph Purchases
Users can purchase oomph packages through our secure payment processing partners. All purchases are one-time payments with no recurring charges or subscriptions.
6.3 Oomph Gifting
Users may gift their paid oomph to other users through our gifting system. The following terms apply:
Giftable Oomph: Only paid oomph (oomph that you have purchased) can be gifted to other users. Free oomph (daily credits) cannot be transferred or gifted.
Gift Types: Oomph can be gifted in two ways:
- Direct Gifts: Oomph is transferred directly to another user's account by specifying their username or email.
- Gift Codes: A redeemable activation code is created, holding the oomph in escrow until claimed by the recipient. Gift codes can be cancelled by the sender before redemption, returning the oomph to the sender's account.
Unlock Levels: Recipients of oomph gifts may receive unlock level upgrades based on the gift amount, mirroring the unlock levels granted by equivalent purchases.
Non-Refundable Gifted Oomph: Once oomph has been gifted and received by another user, it becomes the property of the recipient and is non-refundable to the original purchaser. Generor operates a closed-end system where only the original purchaser of oomph can receive refunds for their unused purchased oomph. If you receive gifted oomph, you cannot redeem it for cash or request a refund—you may only use it for AI generations on the platform.
Gift Transactions: All gift transactions are logged and visible in the oomph transaction history (/oomph) for both senders and recipients.
6.4 Creator Rewards Program
Generor offers a Creator Rewards Program that allows users to earn platform credits when other users purchase physical products (such as t-shirts or wall art) featuring their designs.
How Creator Rewards Work:
- Eligibility: When another user purchases a physical product featuring a design you created on Generor, you may receive platform credits as a creator reward.
- Reward Amount: Creator rewards are currently set at 100 oomph per qualifying purchase. Reward amounts may be adjusted at our discretion.
- Pending Period: Creator rewards are held in pending status for 30 days after the purchase date to account for potential returns, cancellations, or chargebacks. Rewards are credited to your account after this holding period.
- Self-Purchases: You do not earn creator rewards when purchasing physical products featuring your own designs.
Nature of Creator Rewards:
- Platform Credits Only: Creator rewards are awarded as oomph credits, which are non-cash, closed-loop platform rewards. Creator rewards have no cash value and cannot be redeemed for money, cryptocurrency, gift cards, or any cash equivalent.
- Platform Use Only: Earned credits can only be used within Generor for AI generations, premium features, and other platform services.
- Not Income: Creator rewards are platform rewards, not income, royalties, commissions, or payments. Users are not employees, contractors, or partners of Alexiuz AS by virtue of participating in the Creator Rewards Program.
- Discretionary: Creator rewards are awarded at our sole discretion and may be modified, suspended, or terminated at any time. We reserve the right to adjust reward amounts, eligibility criteria, or program terms.
- Revocable: We may revoke pending or credited rewards in cases of fraud, abuse, violation of these Terms, or if an order is returned, cancelled, or charged back.
Design License Grant:
By creating and saving designs on Generor that are eligible for physical product purchases, you grant Alexiuz AS a non-exclusive, worldwide, royalty-free license to reproduce, display, and sell physical products featuring your designs. You retain ownership of your original creative input, but you grant us the necessary rights to operate the physical products service. We are the merchant of record for all physical product sales.
No Guarantees:
We do not guarantee any specific volume of purchases, earnings, or rewards. The Creator Rewards Program is provided "as is" without warranties of any kind. Participation in the program does not create any employment, contractor, or partnership relationship.
6.5 Refund Policy
Spent Oomph: Oomph that has been spent on AI generations (images, text, audio, video, etc.) is non-refundable. Once oomph is used to generate content, the transaction is final.
Unspent Oomph: Subject to applicable law, paid oomph that has not been spent, has not been gifted to another user, and has not expired under Section 6.1 is eligible for refund. To request a refund for unused oomph, please contact us at mail@generor.com.
Processing Fees: Refunds of unused oomph are subject to a processing fee to cover payment processor costs (typically 3-5% of the refund amount, with a minimum fee). The exact fee will be disclosed at the time of refund processing.
Free Oomph: Free oomph provided as part of account benefits or promotions is not eligible for refund and has no cash value.
Gifted Oomph: Oomph that you have received as a gift from another user is not eligible for refund. Only oomph that you have personally purchased can be refunded. This is a closed-end system—gifted oomph has no cash value to the recipient.
7. Termination
We reserve the right to suspend or terminate your access to the Service at our sole discretion, without prior notice or liability, for any reason, including violation of these Terms.
8. Limitation of Liability
In no event shall Alexiuz AS be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses resulting from:
- Your access to or use of the Service.
- Any conduct or content of any third party on the Service.
- Any content obtained from the Service.
9. Indemnification
You agree to defend, indemnify, and hold harmless Alexiuz AS and its affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from:
- Your use of and access to the Service.
- Your violation of any term of these Terms.
- Your violation of any third-party right, including without limitation any privacy or intellectual property rights.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of [Country/State], without regard to its conflict of law provisions.
11. Changes to Terms
We reserve the right to modify or replace these Terms at any time. We will provide notice of any significant changes by posting the new Terms on this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
